Okay, this seemed to involve a HIPAA breach if an employee gave Schefter the medical record in quesiton. But can JPP win in a suit against a reporter/journalist for posting it, or will the First Amendment/freedom of press prevail? If Schefter didn’t encourage an employee to steal or disclose the medical record, all he’s done is to use what he received, and I’m not sure that he’s violated any law as there was public interest in the subject.
