A Pueblo West man has filed a lawsuit against the University of Colorado Health Sciences Center on behalf of his daughter, who sought treatment at the university hospital in Denver and was sent to a New Mexico prison for her trouble.
Kimberly K. Lusardi, 36, is serving an eight-year sentence in New Mexico for passing fraudulent checks. But her father, Mark Lusardi, said it shouldn’t have come to this.
Mark Lusardi believes a social worker employed by the university hospital violated his daughter’s rights to privacy by reporting the results of a blood test to her probation officer.
“I think it just shows their complete reckless disregard for my daughter’s rights,” he said.
In the lawsuit, Lusardi alleges the university and social worker Nora Cavelli violated his daughter’s privacy by disclosing the confidential information and were negligent in doing so.
