Patients at Dallas County Judicial Treatment Center sue Cornell Companies for Privacy Violation

Posted on January 6, 2011 by Dissent

Courthouse News reports:

DALLAS – Cornell Cos., which builds and operates jails, told 35 women it would film treatment sessions for a video to be shown only to drug court judges, but used it to promote its business, the women claim in Dallas County Court.

The complaint, filed in Texas by Theresa Watkins and 35 other individuals against Cornell Companies, alleges that while Cornell was operating the Dallas County Judicial Treatment Center (for drug and alcohol addiction), staff filmed patients in treatment and other activities, and misinformed them that the film of the treatment session would only be shown to the Drug Court judges who supervise the program.

The complaint alleges violations of both Texas and federal statutes concerning the confidentiality of patient records and consent requirements, but does not seem to specifically cite HIPAA.
