Advocate Health, which had already succeeded in getting other potential class action claims dismissed, has now also succeeded in getting a claim that they violated the Fair Credit Reporting Act dismissed.
Plaintiffs, who generally attempt a variety of state and federal claims in breach lawsuits, had argued that by failing to adequately secure patient information, Advocate Health had violated the FCRA. The court rejected the argument, holding that Advocate Health is not a credit reporting agency.
