The lawyers, who are pursuing a class-action lawsuit against the hospital and former worker, said the offer was inadequate. They want UMass Memorial to pay “the modest sum” of $3,000 per class member and provide broader identification security for the affected patients.

In addition to the $7.2 million cumulative settlement proposal by Mr. Mazow and Mr. Yasi, the lawyers were also seeking that the hospital pay for a company that specializes in protection against personal identity theft and medical identity theft for up to 10 years, given that identity thieves tend to hold the information until a victim has let his guard down before trying to use it.

AND

Pursuant to federal law, the lawyers also want the hospital to provide more details of the breach for each of the affected patients; give regular accounting disclosures to the putative class for 10 years; and for the medical center to agree to pay for a health-privacy expert for Mr. Jackson and the potential class-action group.
