The Peterborough Regional Health Centre has lost its battle to stop a class-action suit from going ahead. Now a group of local plaintiffs whose records were accessed improperly can move forward with their lawsuit against the hospital.
The suit alleges damages from a privacy breach at the hospital. Lawyer Michael Crystal has filed the suit on behalf of affected patients, who are suing the hospital for $5.6 million in gerneral, punitive and aggravated damages.
On Wednesday, the Ontario Court of Appeal ruled that the suit can go ahead. PRHC had argued that the court has no jurisdiction over the case according to current privacy law. On Wednesday, the appeals court ruled that patients can sue over breaches.
