New Hampshire’s attempt to shield doctors’ prescription records from drug companies does not violate the Constitution, the First Circuit Court of Appeals has ruled.
In a 148-page ruling made public today, the appeals court overturned a ruling by the state’s U.S. District Court, and found that keeping prescription records confidential does not violate the First Amendment.
The law, enacted last year, barred drug companies from getting access to records of prescriptions written by doctors. New Hampshire was the first state in the country to pass such a law.
