From the transcript and the video of the news, it appears that these are likely student health records held by Lee County School District. But who had them at the time they scattered remains to be determined — was it a vendor taking them for secure destruction and they fell off a truck, or what happened? There’s a lot to find out in terms of accountability. DataBreaches has sent an inquiry to the district, and will update this post if a reply is received.
But despite the questions raised on the video, this likely does NOT involve HIPAA as student health records of the kind described are under FERPA, and the district will never be successfully sued by any irate parents.
