Main Justice reports that a lawsuit against Barnes & Noble over their hacked pin pads has been dismissed because the plaintiffs failed to even demonstrate that their information was stolen, much less that they were harmed or experienced unreimbursed costs for an imminent jury. Plaintiffs can amend the complaint to try to demonstrate harm, but reading Main Justice’s summary of the opinion, it sounds like they are facing an uphill battle.
