Complimentary Webinar: HIPAA Federal Breach Notification in Stimulus Legislation (ARRA)

Lisa Sotto, a Partner with Hunton & Williams LLP, will review the new federal data breach legislation that was signed into law on February 17th (the American Recovery and Reinvestment Act). Lisa will discuss the requirements of the new federal breach notification law, such as the obligation to notify affected individuals within 60 days of discovery of a breach. The new federal breach requirement applies to any organization that maintains or uses “unsecured protected health information.” Lisa will discuss how the new legislation may lay the ground work for a broader federal data breach law.

As of January 1, 2009, California Legislation, AB 211 requires providers of health care to establish and implement appropriate administrative, technical, and physical safeguards to protect the privacy of a patient’s medical information. Alex Kam, Acting Director of the California Office of Health Information Integrity, will provide an overview of the provisions contained within the bill and what this means for health care providers and other persons or entities.

Bo Holland will provide and overview of the Debix Data Breach Preparation Program and how major health care companies leverage the program today to handle breaches of any size – from a single individual to large breaches. Having a preparation program was a best practice with the new stimulus bill to notify within 60 days it is now an absolute necessity.
