A network of California cancer centers is facing a $57 million lawsuit from a putative class of patients alleging the health care provider is responsible for carelessly handling their private information after a data breach.
The putative class action had been filed in California state court in late May then removed by 21st Century Oncology of California to federal court Wednesday. Daniel Padilla alleges that he was a patient at one of the network’s treatment centers and received notice in March that his data was accessed by an unauthorized third party.
“This putative class action arises from defendants’ admitted failure to maintain and secure the medical information of plaintiff and all others similarly situated and defendants’ unauthorized disclosure of such highly confidential medical information to the public,” the complaint states.
The putative class is estimated to comprise 55,000 past and present patients.
